General Provisions
eKool AS (hereinafter eKool) and the registered user (hereinafter the client) of its website http://www.ekool.eu (hereinafter the website) registered user (eKool and the client jointly named as the parties) hereby enter into an agreement for the provision of the mKool service (hereinafter as the agreement).
Details and terms of the service
mKool (hereinafter as service) is a service that enables the client to receive information via the mobile application of eKool about study information (grades, graded assignments, absences, tardiness, remarks, homework, etc.) entered in eKool in relation to a student.
mKool only discloses the agreed data to the client on the person in the role of a student to whose data the client has been granted access by the school.
To start using the full functionality of the service, the client needs to download and run the required application on its mobile phone.
To use the service, the client needs to enter the mobile phone number required for the monthly remittance (hereinafter the service related mobile phone number) on the website and confirm the subscription to the service with a code sent to it.
If the client changes the service related mobile phone number, the client should deactivate the service on the website and enter into a new agreement with the changed mobile phone number.
If the client changes the mobile network operator, eKool shall deactivate the service itself and the client needs to enter into a new agreement with the changed or transferred mobile phone number.
eKool shall have the right to choose the clients to whom the service is provided.
eKool shall have the right to process and store the service related mobile phone number.
When the client has entered into the agreement and activated the service, the service shall also be available to every user in the role of a student linked to the client (hereinafter the student).
The student can use the service according to the restrictions established for the student’s user role on the website.
If a student under the age of 18 wishes to use the service, the parent or legal guardian should give its consent to be liable for the fulfilment of the obligations of the student under the agreement.
Liability and safety
The client confirms that it is entitled to use the service and that there are no other legal aspects, which could prevent the use of the service or cancel any arrangements under the agreement.
The client confirms that it has carefully read the agreement and terms related to the provision of the service, and all terms are understandable, unambiguous and acceptable to the client.
The client is aware and accepts that eKool provides the service through third parties (mobile network operators), who can restrict the provision of the service.
The client is aware and accepts that use of the service entails risks, including that the transmitted information could become available to third parties, the transmitted information could be counterfeited, etc.
The client shall be liable for damages caused to eKool for reasons attributable to the client pursuant to the terms of the general agreement for services.
eKool shall be liable towards the client only for damages arising from the non-fulfilment of its obligations pursuant to the terms of the general agreement for services.
eKool shall not be liable for service failures or malfunction nor damages arising from the use of the service for reasons beyond the control of eKool (incl. functioning of the mobile network, accessibility or safety of the application).
eKool shall not be liable for the expenses of the client incurring with the use of the service.
eKool acts solely as a transmitter of information entered by the school, and shall not be liable for the accuracy and integrity of the information provided nor for providing the access to the clients data.
Service fee
eKool shall have the right to charge a periodic service fee from the client for using the service (hereinafter the f ee).
The fee is published in eKools price list on the website.
The fee is client related, irrespective of the number of users related to the parent using the service in the role of a student pupil.
The fee is added to the monthly invoice of the service related mobile phone number, or automatically deducted from the call card of the the service related mobile phone number.
The payment deadline, penalty for late payments and the method for debt collection shall be determined by the mobile network operator of the client pursuant to its own terms of settlement.
Upon using a service related mobile phone number belonging to a third party, the client confirms with entering in the agreement that the owner of the number accepts the fee.
When the free use period of the service expires, a prepayment for the service for each subsequent 30 calendar days shall be charged.
Upon cancelling the service, the prepaid amounts shall not be refunded.
eKool shall have the right to charge the fee from the client even if the client is unable to use the service for reasons not attributable to eKool.
eKool shall have the right to change the fee amount at any time by notifying the client thereof at least one month in advance on eKools website.
eKool shall have the right to offset the clients prepayments from any amounts payable to eKool.
eKool shall suspend the fee calculation from the beginning of a new payment period in the event that eKool has not sent a single notice to the client during the last twenty one consecutive days at a minimum. eKool shall resume the fee calculation from the time of sending the first notice following the suspension of of fee calculation.
Validity, modification and termination of the contract
The agreement shall enter into force from the moment of its conclusion, i.e. following the acceptance of the terms of the agreement.
The agreement is entered into for an unspecified term.
For aspects not regulated in the agreement, eKools general agreement for services and Privacy Principles, which are deemed an integral part of this agreement, shall apply.
eKool shall have the right to unilaterally modify the agreement by notifying the client thereof at least one calendar month in advance on eKools website.
The client shall have the right to terminate the agreement at any time. To terminate the service, the client should complete a service unsubscription application on eKools website, following the instructions.
eKool shall have the right to terminate the agreement by notifying the client thereof at least one calendar month in advance.
eKool shall have the right to unilaterally and immediately terminate the provision of service without prior notice to the client or to decline the provision of the service to the client who is unable to pay for the service due to its financial situation, the balance of the call card of the service related mobile phone number, the terms of the contract of the mobile network operator or for other reasons. eKool shall also not provide the service if access to the service has been prohibited upon the client’s request.
